Terms of Service Agreement

Article 1: Parties & Acceptance

This Agreement governs the legal relationship between "Nozherha Hona" (hereinafter "the Store" or "First Party") and any individual or entity accessing, browsing, creating an account, or placing an order through the website nozherha.com (hereinafter "User" or "Customer"). Accessing the website or placing an order constitutes full, unconditional legal acceptance of these Terms of Service.

Article 2: Handcrafted Product Specifications

All products listed on the website are classified as made-to-order handmade artisan goods sculpted using polymer clay and associated artistic media. Given the manual, non-automated production process:

• Product photographs displayed on the website are representative models; minor variations in color tone or minute sculpting details are inherent characteristics of handmade items and do not constitute product defects.
• The Customer must adhere to product care instructions (including avoiding dishwashers, microwaves, or prolonged soaking in hot water for polymer clay mugs). The Store shall not be liable for damage resulting from improper handling or misuse.

Article 3: Made-to-Order & Custom Specifications

Pursuant to Article (17) of the Egyptian Consumer Protection Law (Law No. 181 of 2018), goods manufactured according to specifications requested by the consumer or personalized items are legally exempt from the right of discretionary return or unilateral cancellation. Accordingly:

• Made-to-order items and orders involving custom names, custom character sculpting, or specific design modifications requested by the Customer become definitive and legally binding upon confirmation and commencement of production.
• The standard production timeline ranges from 3 to 7 business days prior to dispatch with the carrier, unless agreed otherwise in writing.

Article 4: Pricing, Payments & Order Placement

• All prices on the website are stated in Egyptian Pounds (EGP) and exclude shipping charges unless explicitly stated otherwise. The Store reserves the right to adjust prices without prior notice, excluding orders already confirmed prior to adjustment.
• The website does not process automated credit card charges or store banking credentials. Order summaries are transmitted through designated communication channels (WhatsApp or direct messaging) to finalize approved payment options (Cash on Delivery, InstaPay, or licensed domestic mobile wallets).

Article 5: Shipping, Courier Delivery & Inspection

• Shipments are handled through licensed third-party courier services across Egypt. The Customer must provide an accurate physical address and an active telephone number.
• The Customer shall be liable for shipping or re-shipment fees resulting from inaccurate recipient data, refusal of receipt without legal justification, or recipient unavailability.

Article 6: Inspection, Defects & Replacement Policy

Shipment inspection and replacement requests are governed by the following statutory rules:

• Exemption from Discretionary Returns: Discretionary returns (change of mind) do not apply to customized, personalized, or made-to-order handcrafted goods pursuant to Article (17) of Egyptian Consumer Protection Law No. 181 of 2018.
• Reporting Apparent Breakage & Transit Damage: The Customer must inspect the parcel upon receipt. Any apparent breakage or courier transit damage must be reported to the Store within twenty-four to forty-eight (24–48) hours of delivery, supported by clear visual documentation (unboxing video or photographs) showing the item in its original shipping packaging.
• Exclusion of Post-Delivery Damage & Misuse: Acceptance of delivery without objection within the forty-eight (48) hour inspection period establishes apparent physical soundness upon receipt; claims arising from subsequent accidental breakage or breach of care instructions shall not be accepted.
• Remedy for Verified Defects: Where a manufacturing defect or duly reported transit damage is verified in accordance with statutory consumer protection provisions, the Store shall re-produce and replace the item or refund the full paid amount without imposing additional shipping charges.

Article 7: Intellectual Property & Proprietary Rights

All artisan designs, product photographs, textual materials, and trademarks published on nozherha.com are the exclusive intellectual property of Nozherha Hona, protected under Egyptian Intellectual Property Law No. 82 of 2002. Commercial reproduction or unauthorized use is strictly prohibited.

Article 8: Limitation of Liability & Amendments

• The Store's aggregate liability in connection with any order shall not exceed the actual purchase price paid by the Customer for that specific order. The Store shall not be liable for indirect damages, third-party courier delays beyond reasonable control, or force majeure events.
• The Store reserves the right to amend these Terms prospectively upon publication on this page, without affecting orders confirmed prior to the amendment date.

Article 9: Governing Law & Jurisdiction

These Terms of Service shall be governed by, interpreted, and enforced in accordance with the substantive laws of the Arab Republic of Egypt. The competent courts of the Arab Republic of Egypt shall possess exclusive jurisdiction over any disputes arising hereunder.
